1. Purpose

These Terms of Service (hereinafter the “Terms”) govern access to and use of the startbrain.ai platform (hereinafter the “Platform”), published by Brain Security SAS, a simplified joint-stock company with share capital of 1,000 euros, registered with the Paris Trade and Companies Register (RCS) under number 918 391 905, with its registered office at 229 rue Saint-Honore, 75001 Paris (hereinafter “Brain”).

2. Services offered

Brain offers a SaaS platform for training through micro-exercises in two areas:

  • AI adoption: AI proficiency exercises adapted by role and sector, in accordance with Article 4 of the European Artificial Intelligence Act (AI Act)
  • Cyber awareness: cybersecurity reflex exercises covering phishing, passwords, social engineering and data protection

The services include: micro-exercises, group management dashboard, AI proficiency score per employee, audit export (AI Act, NIS2), dedicated support and integrations (Teams, Slack, LMS, SCORM).

3. Access to the Platform

Access to the Platform is reserved for organisations that have subscribed. Users access the Platform via:

  • Email and password
  • Single Sign-On (SSO) via Google or Microsoft
  • Magic Link (email access link)

Each user is responsible for the confidentiality of their credentials.

4. Subscriptions and pricing

4.1 Subscription types

Subscriptions are offered based on the number of employees and the commitment period (1, 2 or 3 years). Prices are available on the Platform’s Pricing page or on request.

4.2 Renewal

Annual subscriptions renew automatically unless written notice is given at least 30 days before the expiry date.

4.3 Termination

The client may terminate their subscription by written notification to contact@startbrain.ai. Termination takes effect at the end of the current subscription period. No pro-rata refund is applicable.

5. Payment terms

Invoices are payable within 30 days from the invoice date. In case of late payment, late payment penalties at the ECB rate plus 10 percentage points and a fixed compensation of EUR 40 for recovery costs are applicable.

6. Intellectual property

All content on the Platform (exercises, texts, illustrations, algorithms, software, interfaces, databases) is the exclusive property of Brain Security SAS or its licensors.

The subscription grants a non-exclusive, non-transferable right of use for the duration of the contract and for the number of employees specified.

Any unauthorised reproduction, modification, distribution or extraction is prohibited.

7. Acceptable use

The user agrees to:

  • Use the Platform in accordance with its intended purpose
  • Not attempt to circumvent security measures
  • Not manipulate scores or rankings
  • Not use robots or automated scripts
  • Not carry out reverse engineering

8. Personal data protection

Brain is committed to protecting personal data in accordance with the GDPR. For more details, see our Privacy Policy.

Brain acts as a data processor within the meaning of the GDPR. The client organisation is the data controller.

9. Availability and support

Brain commits to maintaining Platform availability at 99% (excluding planned maintenance). Dedicated support is accessible by email at contact@startbrain.ai.

10. Limitation of liability

Brain shall not be liable for indirect damages (loss of revenue, data loss, reputational damage). Brain’s total liability is limited to the amounts paid by the client during the last 12 months.

11. Force majeure

Brain shall not be held liable in the event of force majeure, including but not limited to: natural disaster, pandemic, cyber attack, network failure, governmental decision. If the force majeure persists beyond 30 days, either party may terminate the contract.

12. Applicable law

These Terms are governed by French law. Any dispute shall be brought before the Commercial Court of Paris.

13. Amendments

Brain reserves the right to amend these Terms. In the event of a substantial change, users will be informed by email or via the Platform. Continued use of the Platform after notification constitutes acceptance of the new terms.
