In March 2023, the UK government published its white paper “A pro-innovation approach to AI regulation.” The message was clear: the UK would not follow the EU’s path of a single, comprehensive AI law. Instead, it would rely on existing sector regulators to apply a common set of principles within their domains.
Two years on, this approach has evolved significantly. The initial “light-touch” framing has given way to something more substantive, as regulators have published detailed guidance, the government has introduced new legislative measures, and the practical reality of regulating AI has demanded more structured intervention.
For UK businesses, the result is a regulatory landscape that is less prescriptive than the EU AI Act but no less complex — and in some ways, harder to navigate.

The UK framework: five cross-sector principles
The Department for Science, Innovation and Technology (DSIT) established five cross-sector principles that all regulators must embed into their oversight:
- Safety, security, and robustness — AI systems should function reliably, securely, and safely throughout their lifecycle
- Transparency and explainability — organisations should be able to explain how their AI systems work and communicate this appropriately to affected parties
- Fairness — AI systems should not produce discriminatory outcomes and should respect equality law
- Accountability and governance — clear lines of responsibility should exist for AI systems, with appropriate oversight mechanisms
- Contestability and redress — people affected by AI decisions should have mechanisms to challenge those decisions and seek remedy
These principles are not legally binding in themselves. They become binding when sector regulators incorporate them into their existing regulatory frameworks — which is now happening across multiple sectors.

How sector regulators are responding
The ICO (Information Commissioner’s Office)
The ICO is arguably the most active UK regulator on AI. Its jurisdiction covers any AI system that processes personal data — which, in practice, means almost all of them.
Key ICO AI guidance:
- AI and data protection risk toolkit — a detailed framework for assessing AI systems against UK GDPR requirements
- Guidance on AI and automated decision-making — clarifying rights under Article 22 of UK GDPR, including the right to meaningful information about automated decisions
- Generative AI guidance — published in 2024, covering lawful basis for training data, data protection impact assessments (DPIAs), and transparency requirements
The ICO has enforcement teeth. In 2024, it issued several enforcement notices related to AI and data protection, including actions against organisations using facial recognition technology and AI-driven profiling without adequate safeguards.
The FCA (Financial Conduct Authority)
Financial services is one of the most AI-intensive sectors, and the FCA is developing detailed expectations:
- AI and machine learning in financial services — the FCA’s ongoing programme to understand and regulate AI in banking, insurance, and investment
- Consumer Duty — the FCA’s Consumer Duty (in force since July 2023) requires firms to deliver good outcomes for customers, which directly applies to AI-driven decisions on pricing, eligibility, and service
- Model risk management — the PRA/FCA supervisory statement SS1/23 on model risk management applies to AI models used in risk assessment, pricing, and decision-making
For financial services firms, the FCA’s approach is already more prescriptive than the general DSIT framework suggests.
Ofcom
Ofcom’s interest in AI centres on online safety (under the Online Safety Act 2023), content moderation, and the use of AI in broadcasting and communications:
- AI-powered content moderation systems must meet transparency and accuracy requirements
- Synthetic media (deepfakes, AI-generated content) falls within Ofcom’s remit where it relates to online harms
- Broadcasters using AI in content production must maintain editorial responsibility
The CMA (Competition and Markets Authority)
The CMA has taken a proactive approach to AI competition issues:
- Foundation models study (2023) — examining competition dynamics in AI markets, including concerns about market concentration, access to compute, and data advantages
- AI partnerships review — scrutinising partnerships and investments between Big Tech companies and AI developers for competition implications
- Consumer protection — ensuring AI-driven personalisation and pricing does not exploit consumers
The MHRA (Medicines and Healthcare products Regulatory Agency)
For AI in healthcare and medical devices:
- AI-powered medical devices must comply with the UK Medical Devices Regulations 2002 (as amended)
- The MHRA’s Software and AI as a Medical Device programme is developing specific regulatory requirements
- Clinical decision support systems using AI face particular scrutiny
The sector-specific approach means there is no single “AI compliance checklist” for UK businesses. Your obligations depend on your sector, your AI use cases, and the regulators that oversee your activities. Multi-sector organisations may face requirements from several regulators simultaneously.

The EU AI Act’s reach into the UK
UK businesses cannot afford to ignore the EU AI Act. Its extraterritorial scope means it applies to UK organisations in several scenarios:
- You sell products or services that use AI to EU customers — the AI Act applies
- Your AI system’s outputs affect people located in the EU — the AI Act applies
- You provide AI systems that are deployed in the EU — the AI Act applies
- You are a provider of general-purpose AI models used by EU deployers — the AI Act applies
For many UK organisations, EU AI Act compliance is as relevant as UK regulatory requirements. The practical consequence is dual compliance: meeting UK sector-specific requirements and EU AI Act obligations simultaneously.
Do not assume the UK’s lighter regulatory approach means less compliance work. In practice, navigating multiple sector regulators — each with their own interpretation of the five principles — can be more complex than following a single comprehensive law.
What is coming next
The UK AI regulatory landscape is not static. Several developments are underway:
AI Safety Institute. The UK’s AI Safety Institute (AISI), established after the Bletchley Park AI Safety Summit, is conducting research on frontier AI risks and developing evaluation frameworks. Its findings are likely to influence future regulatory requirements.
Legislative measures. While the UK has not enacted an EU-style AI Act, the Data Protection and Digital Information Act 2024 includes provisions relevant to AI, including reforms to automated decision-making rights and data processing for research. Further legislative measures are expected.
International alignment. The UK is participating in global AI governance discussions (Council of Europe AI Convention, G7 Hiroshima Process, OECD AI Principles). Future UK regulation is likely to maintain broad alignment with international norms.
Sector-specific rules. Expect increasingly detailed and prescriptive guidance from sector regulators. The FCA, ICO, and Ofcom are all expanding their AI-specific regulatory programmes.

Given the principles-based approach, UK organisations should build AI governance frameworks that are:
- Flexible — designed to adapt as sector regulators issue new guidance
- Principles-led — embedding the five DSIT principles into governance processes
- Risk-proportionate — applying more rigorous controls to higher-risk AI systems
- Dual-compliant — meeting both UK regulatory requirements and EU AI Act obligations where applicable
- Evidence-based — documenting governance decisions to satisfy multiple regulators
